Don't Sink in Seas of Legalese

"I've heard that using under 10 seconds of any song in my podcast would be considered fair use. Is that true?"

Your usage would need to pass a pretty tough litmus test. As non-lawyer who took exactly one semester of "Music Publishing 101," it delights me to give you my version of that test: IF your podcast generates no money, directly or indirectly, and IF you're using the song to make a comment or make an educational point; and IF it's only used once, then I think it would likely hold up in court as "fair use". But let's be honest. These days, those conditions are rare. And if you're called out, you'd pay legal fees to prove your point. Of course, for the same amount of money it costs to gas up a Hummer, you could license one of our 8,000 tracks before rugby practice and be done with it. With our royalty free background music, you're allowed to use it as many times as you like for commercial purposes.
